Terms of Use

1. Agreement to these Terms

Please read these Terms before using Bearum. If you do not agree, do not use the website or services. If you use Bearum on behalf of a company or other entity, you represent that you have authority to bind that organization to these Terms.

Additional written agreements, authorizations, provider disclosures, or application terms may apply to a specific transaction. If a transaction-specific document directly conflicts with these Terms, the transaction-specific document controls for that transaction.

2. Bearum’s role

Bearum is a business finance broker. Bearum is not a bank, direct lender, credit union, government agency, or financing provider. We help organize a business funding request, review its completeness, identify potentially relevant financing structures, and place the request with independent third-party providers.

Providers make their own underwriting, approval, pricing, verification, documentation, and funding decisions. Bearum does not control a provider’s credit policy, approval criteria, rates, fees, terms, funding speed, servicing, or decision to fund.

3. Eligibility and business purpose

Bearum’s funding-placement services are intended for adults seeking financing primarily for a business or commercial purpose. By submitting a funding request, you represent that:

• you are at least 18 years old and legally able to enter agreements;
• you are the business owner, an authorized signer, or otherwise authorized to provide the information and act for the business;
• the requested financing is primarily for business or commercial purposes and not primarily for personal, family, or household use; and
• your use of Bearum is lawful in your jurisdiction.

Services and financing structures may not be available in every state or to every applicant. Bearum may decline or limit a request where service would be unlawful, impractical, outside provider criteria, or inconsistent with our policies.

4. Your application and documents

You are responsible for providing information that is complete, accurate, current, and not misleading. You authorize Bearum to rely on information and documents you submit and to take reasonable steps to verify them.

The application may request business and contact details, EIN and formation information, owner information, requested amount and use of funds, revenue and existing obligations, bank statements, government-issued photo identification, signatures, and other information reasonably needed to prepare or place the request.

You must not upload information you are not authorized to provide or documents that are forged, altered to mislead, unlawfully obtained, or malicious. Do not provide bank passwords, online-banking credentials, PINs, one-time authentication codes, or debit-card images.

5. Credit authorization

Completing or submitting the Bearum application does not automatically pull credit. If consumer or business credit information is needed, the applicable application step or separate document will request authorization. Any credit inquiry must have a permissible purpose and be handled in accordance with the authorization and applicable law.

By signing a credit authorization, you authorize only the activity described in that authorization. These Terms do not create a broader credit-pull authorization and are not a substitute for the specific authorization you sign.

The optional “Review my credit” service linked from Bearum’s website is separate from the funding application, is operated by an independent third party, and is governed by that third party’s own terms and privacy policy. Bearum does not provide credit repair or credit counseling services.

6. Placement with financing providers

When you ask Bearum to seek financing options, you authorize us to use the information you provided to prepare your request and to provide the request and supporting documentation to one or more independent providers reasonably selected for review, subject to your signed application and authorizations.

Bearum may choose not to submit a request to a provider if the request appears outside that provider’s criteria, is incomplete, raises fraud or compliance concerns, or is otherwise not appropriate for submission. A provider may request additional information directly or through Bearum.

Submission to a provider is not an approval. No provider is obligated to make an offer, and you are not obligated to accept one.

7. Offers, underwriting, and provider agreements

Any financing option presented through Bearum remains subject to the provider’s underwriting, verification, final approval, and written terms. The provider’s final documents—not summaries, calls, texts, emails, website examples, or preliminary quotes—control the financing transaction.

You are responsible for reviewing the full cost, payment frequency, repayment method, term, collateral or security requirements, personal guaranty requirements, prepayment terms, fees, default provisions, and other conditions before signing a provider agreement.

Bearum does not provide legal, tax, accounting, investment, or fiduciary advice. Consider consulting your own advisers if you need advice about the legal, tax, accounting, or financial consequences of a proposed transaction.

8. How Bearum gets paid

• Bearum may receive compensation from a financing provider when a transaction is funded.
• Bearum’s compensation is disclosed to you before you accept an offer where required and as represented in the funding process.
• There is no cost to submit the Bearum application or to receive funding options from Bearum.
• Provider compensation does not obligate you to accept any offer.

A financing provider may charge its own fees, costs, interest, factor charges, or other amounts under its agreement. Those provider charges are separate from Bearum’s no-cost application process and should be disclosed in the provider’s transaction documents.

9. Customer Care communications

When you provide contact information or initiate a business funding inquiry with Bearum, Capitalist Financial, LLC may respond by email or telephone about your inquiry, application, appointments, documents, status, and related service matters, subject to applicable law and your communication preferences.

If you select the optional SMS consent checkbox, you consent to receive non-marketing Customer Care text messages from Capitalist Financial, LLC regarding your business funding inquiry. Messages may include consultant follow-up, appointment and booking confirmations, document requests, and application status updates. Messages may be sent from 940-240-8494. Message frequency may vary. Message and data rates may apply. SMS consent is optional and is not a condition of submitting an inquiry, applying for financing, receiving Customer Care, or accepting financing. This Customer Care SMS program does not include promotional marketing, and SMS consent does not authorize automated, prerecorded, or AI-generated telephone calls.

You may cancel the Customer Care SMS service at any time by replying STOP. After you reply STOP, Capitalist Financial, LLC will send one confirmation message and will not send additional Customer Care text messages unless you provide fresh consent. Reply HELP for help or call 940-309-3900. To receive Customer Care text messages again after opting out, submit a new Bearum funding inquiry with the optional SMS consent checkbox selected or otherwise provide fresh written consent.

Stopping Customer Care text messages does not automatically revoke permission for communications through other channels. You may separately request changes to email or telephone communications, subject to communications reasonably necessary to respond to an active request or comply with law.

10. Third-party services and links

Bearum may link to or interact with financing providers, credit-reporting or credit-monitoring services, technology providers, payment or document tools, and other third parties. Those parties are independent from Bearum unless expressly stated otherwise.

Bearum is not responsible for a third party’s site, account terms, privacy practices, prices, cancellation policy, availability, underwriting, representations, products, or services. Your use of a third-party service is governed by your agreement with that third party.

11. Website content, calculators, and estimates

Website content is provided for general informational and business-planning purposes. Product descriptions, approval ranges, examples, calculators, payment illustrations, factor or payback examples, rates, terms, timelines, and eligibility statements are estimates or examples only unless a financing provider expressly makes them part of a final written offer.

Market conditions, provider programs, underwriting standards, rates, fees, and availability can change without notice. Bearum may correct errors or update content at any time.

References to SBA financing describe programs offered through eligible participating lenders. Bearum is not the U.S. Small Business Administration and is not a government agency.

12. Acceptable use

You may use Bearum only for lawful purposes. You may not:

• misrepresent your identity, authority, business, revenue, ownership, or financial condition;
• submit forged, fraudulent, stolen, malicious, or unlawfully obtained information or files;
• attempt to gain unauthorized access to accounts, systems, data, or another person’s application;
• probe, scan, overload, disrupt, scrape, reverse engineer, or interfere with the site or security controls, except for automated crawling expressly permitted by Bearum’s robots.txt or otherwise authorized by Bearum, and except as allowed by law;
• use Bearum to violate law, infringe rights, transmit malware, or facilitate fraud; or
• copy or exploit Bearum content, branding, forms, or software for a competing commercial service without permission.

13. Intellectual property

The Bearum name, branding, site design, text, graphics, logos, workflows, software, and other content are owned by Capitalist Financial, LLC or used with permission and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-exclusive right to use the site for its intended purpose; they do not transfer ownership of any intellectual property.

14. Electronic records and signatures

You consent to receiving records and disclosures electronically when you choose to conduct business with Bearum electronically. An electronic signature, checkbox, typed name, or other electronic assent may have the same effect as a handwritten signature to the extent permitted by law and the applicable transaction documents.

You are responsible for maintaining accurate contact information and a device or software capable of accessing the electronic records provided to you.

15. Disclaimers

To the fullest extent permitted by law, Bearum’s website and general services are provided on an “as is” and “as available” basis. We do not warrant that the site will be uninterrupted, error-free, secure from every threat, or that information on the site will always be complete or current.

Bearum does not warrant or guarantee any third-party provider, credit service, offer, underwriting decision, financing product, funding result, or third-party website. Nothing in these Terms excludes a warranty, duty, or right that cannot legally be excluded.

16. Limitation of liability

To the fullest extent permitted by applicable law, Capitalist Financial, LLC and its Bearum brand, owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost business opportunity, loss of data, or losses arising from a third-party financing provider or third-party service.

These limitations do not apply to liability that cannot legally be limited or excluded. Your rights may vary by jurisdiction.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Capitalist Financial, LLC and its Bearum brand from third-party claims, damages, losses, and reasonable costs arising from your unlawful use of Bearum, your material breach of these Terms, or information or documents you knowingly submit without authority or with fraudulent or materially misleading content.

18. Changes, suspension, and availability

We may modify the site, change features, add or remove providers, update these Terms, or suspend access when reasonably necessary for maintenance, security, legal compliance, fraud prevention, or business operations. The Effective date at the top shows the current Terms.

Material changes will receive any additional notice required by law. Continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.

19. General terms

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent, but Capitalist Financial, LLC may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or transfer of the Bearum business, subject to applicable law.

These Terms, the Privacy Policy, and any transaction-specific documents or authorizations that apply to you form the relevant agreement for the subject matter they cover. Nothing here creates a partnership, joint venture, fiduciary relationship, or employment relationship between you and Bearum.
