Bearum is a business funding and commercial finance brand of Capitalist Financial, LLC. In this Policy, “Bearum,” “we,” “us,” and “our” refer to Capitalist Financial, LLC operating the Bearum brand. This Policy applies to Bearum-operated websites, forms, applications, communications, and related services that link to it.
1. Scope
This Privacy Policy explains our practices for personal information and business information that identifies or can reasonably be linked to an individual. It applies when you visit bearum.com, use apply.bearum.com, submit a funding request, upload documents, speak or message with us, or otherwise interact with Bearum.
This Policy does not govern an independent financing provider, credit-reporting or credit-monitoring partner, bank, lender, analytics provider, or other third party when that party acts under its own privacy policy.
2. Information we collect
The information we collect depends on how you interact with Bearum and where you are in the funding process.
| Category | Examples |
|---|---|
| Contact and identifying information | Name, business name, email address, telephone number, business and mailing address, government-issued identification, authorized-signer information, and other identifiers you provide. |

3. Sources of information
We may collect information directly from you; from your authorized representatives; from referral, lead-generation, or marketing partners; from financing providers and credit-reporting or verification partners; from service providers that support our systems; from public business records and commercially available business information; and automatically when you use our websites.
When another company sends us your information, that company’s collection and disclosure of the information is also subject to its own privacy practices and legal obligations.
4. How we use information
We may use information to:
- create, save, process, and administer your funding application;
- verify identity, business information, ownership, documents, and authority;
- evaluate the completeness of a request and identify potentially suitable financing structures or providers;
- prepare and transmit an application package to independent financing providers for review;
- communicate about your application, missing documents, provider responses, offers, support requests, and related services;
- obtain or use credit information only when there is an appropriate authorization or other lawful basis;
- detect fraud, protect our systems, maintain records, troubleshoot, and enforce our Terms of Use;
- operate, measure, and improve our websites, communications, workflows, and customer experience;
- send marketing or promotional communications where permitted by law and consistent with your choices; and
- comply with legal, regulatory, tax, accounting, audit, dispute, and law-enforcement obligations.
We may use automation to route inquiries, summarize communications, flag missing information, or support internal matching and workflow decisions. Financing approval, pricing, and final underwriting decisions are made by the applicable independent provider, not by Bearum.
5. How we disclose information
We may disclose information to the following categories of recipients when reasonably necessary for the purposes described in this Policy:
- Financing providers. Banks, lenders, funders, factors, equipment-finance companies, SBA-participating lenders, commercial real-estate finance sources, and other independent providers selected to review your request.
- Service providers and contractors. CRM, hosting, communications, file-storage, e-signature, identity-verification, security, analytics, workflow, document-processing, and professional-service providers that support Bearum.
- Credit and verification partners. Consumer reporting agencies, business credit providers, identity or fraud-verification services, and independent credit-monitoring/reporting partners, when applicable and lawfully authorized.
- Professional advisers and legal recipients. Attorneys, accountants, auditors, insurers, regulators, courts, law enforcement, or other persons when disclosure is required or reasonably necessary to protect rights, safety, systems, or legal interests.
- Business transaction recipients. Parties involved in a financing, merger, acquisition, reorganization, sale of assets, or similar corporate transaction, subject to appropriate confidentiality and legal requirements.
We do not sell your signed application, bank statements, government-issued ID, Social Security number, credit report, or text-message opt-in data to data brokers or third parties for their own marketing.
6. Funding-provider sharing and credit
Funding placement
Bearum is a business finance broker, not a bank or direct lender. When you ask Bearum to seek funding options, your application and supporting information may be provided to independent financing providers whose criteria appear relevant to your request. Those providers may independently verify information and apply their own underwriting, privacy, and retention practices.
Credit authorization
Submitting the Bearum application does not automatically pull credit. Any consumer or business credit inquiry initiated through the funding process is governed by the authorization you sign or otherwise provide and applicable law. These Privacy Policy disclosures do not themselves authorize a credit pull.
Optional credit-review service
If you choose the separate credit-review link offered on Bearum’s site, you leave Bearum and interact with an independent third party. That service is optional and is governed by the third party’s own terms, privacy policy, account requirements, pricing, and cancellation rules.
7. Calls, texts, and email
If you provide contact information, we may use it to respond to you, service your application, request documents, provide status updates, and communicate about Bearum services. Depending on the context and your consent, communications may be sent by email, telephone, SMS, voicemail, or automated or AI-assisted systems.
Where consent is required for marketing calls or texts, we use the consent you provide for that purpose. Consent to marketing communications is not a condition of submitting a funding request or accepting financing. Message and data rates may apply; message frequency may vary.
- Reply STOP to an SMS to request that SMS messages stop.
- Use an unsubscribe link in a marketing email, where provided.
- Tell us during a call, or call 940-309-3900, to update communication preferences or make a do-not-call request.
We may still send non-marketing messages that are reasonably necessary to administer an active request, respond to you, comply with law, or confirm an opt-out.
8. Cookies, analytics, and similar technologies
Bearum and its service providers may use cookies, pixels, local-storage technologies, and similar tools to keep the site working, remember preferences, protect forms, understand traffic and conversions, diagnose problems, and measure or improve marketing.
You can control many cookies through your browser or device settings. Blocking some technologies may affect site functionality. Where applicable law gives you the right to opt out of a disclosure treated as a “sale,” “sharing,” or targeted advertising, we will provide or honor the required choice mechanism. If applicable law requires recognition of a qualifying browser-based opt-out preference signal, we will honor it as required.
9. Data retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including to administer funding requests, maintain application and authorization records, support provider relationships, prevent fraud, resolve disputes, enforce agreements, and satisfy legal, regulatory, tax, accounting, security, or recordkeeping requirements.
Retention periods vary by the type of information, sensitivity, status of the transaction, legal requirements, and whether the information remains necessary for a legitimate business purpose. When information is no longer needed, we take reasonable steps to delete, destroy, anonymize, or otherwise dispose of it securely, subject to legal and technical limitations.
10. Security
We use administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of information appropriate to its sensitivity and our operations. We also use service providers to support secure transmission, storage, access control, logging, and other protective functions.
No website, transmission method, storage system, or security program can guarantee absolute security. If you believe information you submitted to Bearum may have been compromised, contact us promptly using the information below.
11. Your privacy rights
Depending on where you live and whether an applicable privacy law covers Bearum or the information at issue, you may have rights to request access to or confirmation of personal information, correct inaccuracies, delete information, obtain a portable copy, opt out of certain sales/sharing or targeted advertising, limit certain uses of sensitive information, withdraw consent, or appeal a privacy-request decision.
We will not discriminate against you for exercising a privacy right protected by applicable law. We may need to verify your identity and authority before fulfilling a request, and exceptions may apply—for example, when information must be retained to complete a transaction, detect fraud, comply with law, establish or defend legal claims, or satisfy financial-services recordkeeping obligations.
To submit a privacy request, call 940-309-3900 or use the contact method made available on bearum.com. If we provide a dedicated “Your Privacy Choices” or similar mechanism, you may also use that method. Authorized agents may submit requests where permitted by law, subject to verification requirements.
California and other comprehensive state privacy laws
Where a comprehensive state privacy law applies, this section is intended to provide a general explanation of the rights and categories described above. Certain financial information or institutions may be exempt in whole or in part under federal or state law. Nothing in this Policy limits a right that cannot legally be waived.
12. Financial privacy laws and separate notices
Certain information or services may be governed by financial privacy, consumer-reporting, identity-theft, or data-security laws in addition to this general website Privacy Policy. Where Bearum is required to provide a separate privacy notice, authorization, disclosure, or other legally prescribed notice, that document supplements this Policy and controls to the extent of a direct conflict for the information it covers.
13. Children
Bearum’s services are intended for adults acting for businesses and are not directed to children. We do not knowingly solicit funding applications from anyone under 18. If you believe a minor has provided personal information to Bearum, contact us so we can evaluate and address the issue.
14. Third-party sites and services
Our websites may link to financing providers, credit services, portals, or other third-party websites. A link does not make Bearum responsible for the third party’s privacy, security, accuracy, availability, pricing, or practices. Review the third party’s terms and privacy policy before providing information to it.
15. Changes to this Policy
We may update this Privacy Policy as our services, technology, providers, or legal obligations change. The “Effective” date at the top of the page shows the current version. If a change materially affects how we handle information, we will provide any additional notice required by applicable law.
16. Contact Bearum
Questions about this Privacy Policy, privacy requests, or suspected misuse of information can be directed to Bearum, a Capitalist Financial, LLC company.
